Employer of Record is a grey area in Kyrgyzstan. The Labour Code of 2025 has no agency-work regime and no ban on it, so an EOR can employ on an ordinary Kyrgyz contract; the only legal opinion we found is one lawyer’s answer on a Q&A site, and we found no law-firm or Big4 text on EOR (Labour Code copy, checked 2026-10-10). The statutory cost on top of gross pay is 2.25% since 2024-08-01, down from 17.25%, so a KGS 4,400,000 salary (about USD 50,300) carries KGS 99,000 of employer contributions (kaktus.media, checked 2026-10-10). The EOR fee comes on top: prices in our table run from $199 to $699 per month, and three providers show a price on a Kyrgyzstan page, from $499 to $699.
Several providers still print the old 17.25% rate. A foreigner from outside the Eurasian Economic Union needs a quota permit applied for through a Kyrgyz employer; no source we found says whether an EOR can be that applicant.
One of the 11 providers names a Kyrgyz company: Remote’s Local Terms name Remote KG LLC as the employer. The other ten name none.
Kyrgyzstan has one national minimum wage and a 2.25% employer contribution since August 2024. The figures come from a copy of the Labour Code of 2025 and from Kyrgyz news sites that quote the Social Fund and the Cabinet, because the official legal, tax and Social Fund databases did not open for us; the sources are marked in each row.
Minimum wage
One national rate, set each year by the republican budget law for unskilled work at full working time (Labour Code art. 92) (Labour Code copy, checked 2026-10-10).
The 2026 figure comes from 24.kg’s article on the draft budget (2025-10-27); a search snippet of Economist.kg says the President signed the 2026 budget law with KGS 3,280, and we did not open that page.
Planned in the same budget cycle: KGS 3,608 for 2027 and KGS 3,968.8 for 2028, from the draft only; a 2025 article gave KGS 3,670 for 2027.
The minimum wage is not the base for contributions or tax; those use the regional average wage as a floor.
National minimum wage, KGS gross per month, rate in force on 31 December each year. The 2022 value is the figure planned by the 2021 budget law and was not confirmed in the 2022 law; for 2024 the 2024 budget law summary gives KGS 2,534, while the 2023 law and some articles give KGS 2,460. Employer contributions
The ordinary employer pays 2.25% of all pay to each employee; the employee’s 10% is withheld from gross. The rates are from the Social Fund’s press service as reproduced by Kaktus.media, which cites the law signed 2024-07-23 (kaktus.media, checked 2026-10-10).
Total employer on-cost for an ordinary office or IT employee under the cap: 2.25% of gross. Before 2024-08-01 the employer paid 17.25% (pension 15%, FOMS 2%, FOT 0.25%) (spinform.ru, checked 2026-10-10).
The reduced rate does not apply to state-funded bodies, commercial banks and some other listed sectors, which stay at 17.25%.
From 2026-01-01 the monthly base is capped at 20 times the national average wage: KGS 632,080 a month, at most KGS 77,430 of combined 12.25% contributions per person (economist.kg, 24.kg, checked 2026-10-10). Both are news reports; we did not read the resolution. The average wage they use (KGS 31,604) conflicts with the KGS 36,047-36,055 averages quoted elsewhere.
The base cannot be below the regional average monthly wage: KGS 36,047 nationally and KGS 44,074 in Bishkek for 2026 per economist.kg. It does not bind at the salaries in our examples.
Conditions for the 2.25% rate: an ordinary business taxpayer, a register of hired employees and non-cash pay. The payment and filing deadline is the 20th; late payment carries 0.09% a day from the 21st (economist.kg, checked 2026-10-10).
Employee income tax: 10% flat, with a personal deduction of KGS 650 a month and the employee’s own contributions deducted from the base. From the 2023 Tax Code edition and a December 2025 answer; we did not read the 2026 edition (Tax Code PDF, checked 2026-10-10).
Working hours and overtime
Normal working time is at most 40 hours a week; the contract may set less. Heavy or harmful work is 36 hours (art. 51).
Overtime needs the employee’s written consent and may not exceed 4 hours over two consecutive days (art. 57). Pay is at least 1.5x for the first 2 hours and at least 2x after; the employee may choose time off instead (art. 108).
Work on rest days and non-working public holidays is banned except in listed cases, needs written consent and is paid at higher rates (arts. 67, 109) (Labour Code copy, checked 2026-10-10). We did not find an annual overtime cap in the articles read.
Annual leave and public holidays
28 calendar days of basic paid leave; 30 for workers under 18 and people with disabilities; extra leave exists for some groups (arts. 68-69). We did not check whether the 28 days include public holidays.
State public holidays (art. 66(1)): 1 Jan, 23 Feb, 8 Mar, 21 Mar (Nooruz), 7 Apr, 1 May, 5 May, 9 May, 31 Aug, 7 and 8 Nov. Orozo Ait, Kurman Ait and 7 Jan are also non-working days (art. 66(3)) (Labour Code copy, checked 2026-10-10).
Probation
Up to 3 months; up to 6 months for heads of organisations and their deputies, chief accountants and their deputies, and heads of branches (art. 24). It must be written in the contract, otherwise the employee is hired without probation.
Sick days and other absence do not count. No probation for under-18s, people hired by competition and contracts up to 2 months (Labour Code copy, checked 2026-10-10).
Notice and severance
Ground
Employer notice
Severance
Liquidation or headcount reduction
At least 1 month, written, against signature; one free day a week to look for work on average pay
At least 2 average monthly wages
Unfit through health or insufficient qualification
At least 2 weeks
1 average monthly wage for health-related unfitness and certain other grounds
A dismissed employee who registers with the employment service within 10 working days keeps average pay for up to 3 months of job search, with the first month’s severance counted in it (art. 48).
The employee resigns on 1 month’s written notice. Dismissal during sick leave or leave is not allowed except on liquidation (art. 46(7)). Contract or collective agreement may give more than the minimum (art. 47(3)).
Fixed-term contracts run up to 5 years and only in cases the Code lists (art. 18). Notice for dismissal for misconduct was not read (Labour Code copy, checked 2026-10-10).
13th salary and bonuses
Not confirmed. A keyword search of the Labour Code found no 13th-salary or similar mandatory annual bonus, but we searched the Code by keyword and did not read it line by line, so we do not say none exists (Labour Code copy, checked 2026-10-10).
Mandatory benefits
Social insurance is delivered through the contributions above: employer Pension Fund, FOMS and Workers’ Wellness Fund; employee Pension Fund and State Accumulative Pension Fund (kaktus.media, checked 2026-10-10).
No mandatory private health, life or pension insurance for the employer was found.
Paid sick leave, maternity and parental leave exist, but we did not extract their amounts, periods or the employer-paid part.
Work permits
A foreign citizen needs a work permit through a Kyrgyz employer and the annual foreign-labour quota (Law of 2006-01-13 No. 4). The applicant is the employer registered in Kyrgyzstan; foreigners may not exceed 20% of an organisation’s workforce (Mondaq, GRATA article, checked 2026-10-10).
Citizens of EAEU states need no permit or quota; highly qualified specialists and cross-border workers are exempt from the quota. Remote workers who are Kyrgyz residents or EAEU citizens need no permit.
Work permit, work visa and residence card are being merged into a Single Permit (up to 60 days at first, then a residence card), applied for by the employer on the Electronic Visa portal in 7-10 working days. From 2026-09-29 these documents are issued by the Ministry of Labour, Social Security and Migration (akchabar.kg, checked 2026-10-10).
Sources disagree on the Single Permit dates and on the 2026 quota (52,000 versus 100,000). Fees, the highly-qualified salary threshold and whether an EOR can be the applicant were not confirmed from a primary source.
Currency and payroll
KGS (som). The National Bank’s official rate dated 2026-10-10 is 1 USD = 87.45 KGS (nbkr.kg, checked 2026-10-10).
Pay at least once a month, on dates set by the collective agreement or internal rules; on termination all sums are due by the last working day. Late payment carries 0.25% of the unpaid amount for each calendar day (art. 94). Legal entities must pay wages in non-cash form (Labour Code copy, checked 2026-10-10).
Is Employer of Record legal in Kyrgyzstan?
Grey area. Kyrgyzstan has no EOR or temporary-agency-work regime in law. The new Labour Code (No. 23 of 2025-01-23, in force 2025-01-28) has no chapter on agency or leased labour and no ban on it either. We searched the Code text by keyword for agency work, leased or loaned workers, outstaffing, outsourcing and private employment agencies and found no provision; we did not read it end to end (Labour Code copy, checked 2026-10-10). See the Employer of Record glossary entry.
Employer by statute. The Code excludes people working under civil-law contracts from labour law (art. 6(7)). Its only transfer-to-another-employer rule is a temporary transfer during idle time of up to 1 month (art. 34(3)).
Remote work. Arts. 184-187 allow remote or combined work and electronic contracts. Labour law applies to foreign nationals in organisations located in Kyrgyzstan and to staff of organisations owned by foreign persons (art. 7). The Code defines the employer as an individual or a legal entity (art. 14(5)) and does not say whether a foreign company with no Kyrgyz registration can itself employ a remote worker.
One lawyer’s opinion. An answer by lawyer Muratbek Azimbaev on zakon.kg, dated 2026-02-09, says there is “no direct prohibition in legislation” on outstaffing with a foreign company: an employment contract with the Kyrgyz company plus a services contract between it and the foreign client. He names two risks, termination tied to the foreign client’s decision and pay outside Kyrgyz payroll. It is a Q&A answer, not a law-firm publication or an official interpretation (zakon.kg, checked 2026-10-10).
ILO Convention 181. The law ratifying the Private Employment Agencies Convention was signed on 2025-10-20; a Ministry of Labour statement says rules for private employment agencies are being prepared. The news stresses agencies placing Kyrgyz workers abroad, and we found no implementing rules (akchabar.kg, checked 2026-10-10).
No firm commentary. Searches for law-firm and Big4 articles on EOR, outstaffing or agency work in Kyrgyzstan returned none. GRATA’s employment overview covers notice, severance and permits but not EOR (gratanet.com, checked 2026-10-10).
Risks for the client:
Reclassification and co-employment. Neither is regulated. A client that directs the worker day to day while a Kyrgyz entity formally employs them has no statutory safe harbour, and no rule on client liability was found. The late-pay penalty (0.25% a day) and severance attach to the Kyrgyz employer; this is our inference from the absence of a rule, not a stated sanction.
Open-ended contracts. Fixed-term contracts are restricted (art. 18), so an EOR hire will normally be open-ended, with notice and severance costs on exit.
Contribution compliance. The 2.25% rate depends on the employer being an ordinary business outside the excluded sectors, keeping a register of hired employees and paying non-cash. Breaches bring penalties and interest (kaktus.media, checked 2026-10-10).
Foreign hires. Non-EAEU foreigners need the quota and permit through the employer. Employers must now ensure the worker’s departure on termination, and non-compliant companies may be listed in a register of unscrupulous entities (akchabar.kg, checked 2026-10-10).
Tax presence. We found no source on permanent-establishment risk for a client whose staff is employed by a local entity. See permanent establishment.
Who actually employs your hire in Kyrgyzstan
We could not search the Kyrgyz company register: the Ministry of Justice register returned a block page to our requests on 2026-10-10, and the mirror sites did not cover Kyrgyzstan. “Own entity” below therefore means a provider’s own document, not a register entry, and no provider’s entity was checked against the register.
Local Terms list “Kyrgyzstan - Remote KG LLC - 33/1 Razzakov Street, Bishek; registered number 201418 - 3300 - ЖЧК”. The country page lists only Contractor Management under available products, while its price block shows Employer of Record

Own entity counts Remote’s Local Terms; the register was not searched. Not disclosed includes providers whose pages describe an EOR’s role in general terms without naming a Kyrgyz company. Source: vendor country pages and Local Terms, checked 2026-10-10.
One of the 11 names which Kyrgyz company employs your hire and the other ten do not. It matters because that company signs the contract, withholds the 10% tax, pays the contributions and would apply for any permit. Before signing, ask: “Which Kyrgyz company signs my employee’s contract, and what is its registration number?”
How to choose an EOR in Kyrgyzstan
Want a named employer? Remote’s Local Terms name Remote KG LLC. Its Kyrgyzstan page lists only contractor management under available products while showing an EOR price, so ask Remote to confirm in writing that EOR hiring is live. For the other ten, ask for the company name and number.
Hiring a non-EAEU foreigner? The permit goes through a Kyrgyz employer and the quota, and no source says whether an EOR can be the applicant. Ask who files and under which entity. Skuad says non-EAEU hires take several weeks longer and Remote People puts the Single Permit at 2-4 weeks extra; these are vendor claims.
Is speed the priority? Deel says a hire can start in as little as 3 days and Rivermate in a few days; Skuad (for Kyrgyz nationals and EAEU citizens), Remote People and Safeguard Global say one to two weeks. All are vendor claims.
Which contribution rate is in the quote? G-P, Rivermate, Atlas and Skuad print 17.25% on their Kyrgyzstan pages, the rate before 2024-08-01; the current rate is 2.25%. Ask which rate the cost estimate uses. On a Kyrgyzstan page Skuad shows $499, Deel from $599 and Remote $699; the rest show global prices or none.

What it costs to employ someone in Kyrgyzstan through an EOR
The statutory cost on top of gross pay is 2.25% for an ordinary employer. The employer is a large-payroll EOR entity employing an office or IT employee on an ordinary open-ended contract, at the 2026 ordinary-business rate (pension 1% + FOMS 1% + FOT 0.25%). Gross pay is KGS 4,400,000 and KGS 8,800,000 a year (KGS 366,667 and KGS 733,333 a month), about USD 50,300 and USD 100,600 at 1 USD = 87.45 KGS, the National Bank’s official rate dated 2026-10-10 (nbkr.kg, checked 2026-10-10).
Employer contributions by fund. The first salary is under the monthly cap of KGS 632,080; the second is above it, so the capped base applies and the cost is 1.94% of gross, not 2.25%. Work-injury cover, employer-paid sick days, leave and severance accruals are not included. Source: kaktus.media, economist.kg, checked 2026-10-10.

Components
KGS 4,400,000/year
KGS 99,000 (2.25% of gross; KGS 8,250 a month)
Pension Fund 1% x 4,400,000 = 44,000; FOMS 1% = 44,000; FOT 0.25% = 11,000. Memo, withheld from the employee: contributions 10% = 440,000; income tax 395,220; take-home 3,564,780
KGS 8,800,000/year
KGS 170,661.60 (1.94% of gross)
Capped base 632,080 x 12 = 7,584,960; Pension Fund 1% = 75,849.60; FOMS 1% = 75,849.60; FOT 0.25% = 18,962.40. Without the cap: 2.25% x 8,800,000 = 198,000. Memo, withheld: contributions 758,496; income tax 803,370.40; take-home 7,238,133.60
The cap rests on news reports of a Government resolution that we did not read, and whether it applies to the employer’s share on the same base is not confirmed. The regional average-wage floor does not bind at either salary.
Not included: work-injury insurance, employer-paid sick days, leave and severance accruals (at least 2 average monthly wages on reduction) and the High Technology Park regime. We found no 13th salary.
The EOR’s own fee comes on top. On a Kyrgyzstan page Skuad shows $499 a month, discounted from $599 on hiring volume, Deel a management fee from $599 and Remote $699 per employee. Global list prices for the others run from $199 (RemoFirst, Remote People) to $639 a month (top of Rivermate’s range); Safeguard Global publishes none.
Hidden costs: none published. No provider we checked publishes a setup fee, deposit, minimum term or termination fee for Kyrgyzstan. Treat a blank as unpublished, not zero.
The same salary costs the employer about 87% less than before the August 2024 reform. Rates in force on 31 December each year; the 2021 rate is taken as the same as 2022-2023. Source: spinform.ru, kaktus.media, economist.kg, checked 2026-10-10.
When you don’t need an EOR
The permit applicant is an employer registered in Kyrgyzstan, and the Code has no co-employment rule. Source: Mondaq, GRATA, Labour Code copy, checked 2026-10-10.
A genuinely independent contractor. An individual entrepreneur (IP) on the simplified system pays the single tax of 2% of revenue for software development when paid in non-cash form, 4% for cash, so KGS 4,400,000 of invoices carries KGS 88,000 (Tax Code PDF, checked 2026-10-10). Guides on the Tax Code as amended on 2026-08-06 still show 2% (tumar.app, checked 2026-10-10). The IP’s own social contributions for 2026 are not confirmed, so we give no take-home figure. The High Technology Park regime (1% of revenue, exemption from profit tax, sales tax and VAT) is open to individuals, but we could not confirm that a contractor-style activity qualifies. See how to pay contractors in Kyrgyzstan and our hiring guide. The Code excludes people under civil-law contracts from labour law (art. 6(7)), and we found no reclassification rule; see contractor misclassification and EOR vs PEO.
Your own entity. The route if you want to be the Kyrgyz employer and the permit applicant yourself; the applicant must be an employer registered in Kyrgyzstan. We found no source on registration time or cost.
Employing without any entity. Whether a foreign company with no Kyrgyz registration can itself employ a remote worker, with tax-agent registration, payroll and contributions, was not found in any source. Treat it as unresolved; see permanent establishment.
What changed in 2026
2026-01-01: the minimum wage rises to KGS 3,280 a month from KGS 2,865; KGS 3,608 is planned for 2027 (24.kg, checked 2026-10-10).
2026-01-01: the monthly contribution base is capped at 20 times the average wage (KGS 632,080; at most KGS 77,430 of combined 12.25% contributions per person). Numbers vendors haven’t updated
Employer contributions. G-P’s page says employers contribute 17.25% (15% pension, 2% compulsory social security, 0.25% healthcare); Rivermate, Atlas and Skuad give 17.25% too. That was the rate before 2024-08-01; since then it is 2.25% for an ordinary employer. Remote People’s page lists “2.25% mandatory social security contributions, 0.25% health fund fees, and 15% pension contributions”, a split that keeps the old 15% pension. Deel’s page gives 2.25% (globalization-partners.com, rivermate.com, atlashxm.com, skuad.io, remotepeople.com, deel.com, checked 2026-10-10).
Minimum wage. In force: KGS 3,280 a month since 2026-01-01. Remote’s page says KGS 2,337, Atlas KGS 2,460 as of January 2024, Borderless AI KGS 2,863 for 2025 and RemoFirst about KGS 1,970. Deel, Skuad and Remote People give KGS 3,280 (remote.com, atlashxm.com, hireborderless.com, remofirst.com, checked 2026-10-10).
Public holidays. Remote’s page counts 14 for 2026; RemoFirst’s and G-P’s say 11. The Code lists 11 state holidays and adds Orozo Ait, Kurman Ait and 7 January as non-working days; we did not reconcile the counts (Labour Code copy, checked 2026-10-10).
How we built this page
Data was collected and checked on 2026-10-10 from a copy of the Labour Code of 2025, a 2023 copy of the Tax Code and Kyrgyz news sites that quote the Social Fund and the Cabinet; the official legal, tax and Social Fund databases did not open for us, so no primary text of the 2024 tariff law, the 2026 cap resolution or the 2026 Tax Code amendments was read. The Kyrgyz company register was also unreachable, so provider entities rest on the providers’ own documents and pages, not on register entries. Providers are ordered with the one that names its own entity first, then by published Kyrgyzstan price and how much Kyrgyzstan-specific information each publishes. No provider pays for placement.
Frequently asked questions
How much does an Employer of Record cost in Kyrgyzstan?
Two layers. The statutory layer is 2.25% of gross for an ordinary employer, so KGS 4,400,000 a year (about USD 50,300) carries KGS 99,000; at KGS 8,800,000 the 2026 contribution cap holds it to KGS 170,661.60. The EOR fee comes on top: $499 to $699 a month on three Kyrgyzstan pages (Skuad, Deel, Remote), and global list prices from $199.
Is Employer of Record legal in Kyrgyzstan?
It is a grey area. The Labour Code of 23 January 2025 has no chapter on agency or leased labour and no ban on it; we searched it by keyword and did not read it end to end. One lawyer on zakon.kg (2026-02-09) says outstaffing for a foreign client is lawful when the worker has a contract with a Kyrgyz company. We found no law-firm or Big4 text on EOR.
Which EOR providers have a company in Kyrgyzstan?
One of the 11 names one: Remote's Local Terms list Remote KG LLC, Bishkek, registered number 201418-3300-ЖЧК. We could not search the Kyrgyz company register, so that is the vendor's own document. The other ten, including Deel and Skuad, name no Kyrgyz company.
What is the cheapest EOR in Kyrgyzstan?
Among prices shown on a Kyrgyzstan page, Skuad is lowest at $499 a month, discounted from $599 on hiring volume, then Deel from $599 and Remote at $699. Global list prices go lower: from $199 a month at RemoFirst and Remote People. Compare them only after you know which Kyrgyz company employs your hire.
What are employer social contributions in Kyrgyzstan?
2.25% of gross since 2024-08-01 for ordinary business employers: pension fund 1%, health insurance fund 1% and the workers' wellness fund 0.25%. Before that date it was 17.25%. The employee pays 10%. Banks, mobile operators and some other sectors stay at 17.25%, and from 2026-01-01 the monthly base is capped at KGS 632,080.
What are the risks of hiring through an EOR in Kyrgyzstan?
No statute covers co-employment, so a client that directs the work day to day has no stated safe harbour. Fixed-term contracts are allowed only in listed cases, so a hire is usually open-ended, and redundancy costs at least 2 average monthly wages. The 2.25% rate also depends on the employer being an ordinary business with non-cash pay and a staff register.
Should I hire a contractor instead of using an EOR in Kyrgyzstan?
If the person works independently, yes: see [how to pay contractors in Kyrgyzstan](/software/contractor-payouts/kyrgyzstan/) and [our hiring guide](/hire-contractors/kyrgyzstan/). An individual entrepreneur on the single tax pays 2% of revenue for software development paid by bank transfer. A person who works under your direction like staff is employment in substance. See [EOR vs PEO](/blog/eor-vs-peo/).
Can an EOR in Kyrgyzstan sponsor a work visa?
Not confirmed. A non-EAEU foreigner needs a work permit and a quota slot through an employer registered in Kyrgyzstan, being merged into a Single Permit, issued by the Ministry of Labour from 2026-09-29. Sources disagree on the 2026 quota (52,000 versus 100,000), and no source says whether an EOR can be the applicant.
