An Employer of Record (EOR) is a grey area in Azerbaijan: the law has no EOR category, licence or limit, and the only law firm we found with a view, Caspian Legal Center, sells the service itself. It calls staff outsourcing unregulated but warns that a tax audit will ask you to explain the model (Caspian Legal Center, checked 2026-10-10). Statutory employer cost is 16.7% of gross at AZN 85,000 a year and 14.6% at AZN 170,000, before accident insurance, which we couldn’t price. The EOR fee comes on top: $99 to $639 per month in published prices, $399 to $599 where a provider prices Azerbaijan itself.
Two things set 2026 apart. The income-tax relief that exempted pay up to AZN 8,000 a month ended on 2025-12-31, so employees now pay 3% up to AZN 2,500 (taxes.gov.az, checked 2026-10-10). And only an Azerbaijani entity, branch, representation or individual entrepreneur can apply for a foreigner’s work permit, so a local EOR entity can and a foreign client without one cannot.
An EOR suits a salaried hire you direct without opening a company in Azerbaijan. For independent project work a contractor is simpler (how to hire contractors in Azerbaijan, how to pay them). None of the 14 providers below confirms its own Azerbaijani entity: Skuad names a local partner, and the other 13 don’t name an Azerbaijani entity.
Employing someone in Azerbaijan: key facts
Employer contributions are tiered and changed on 2026-01-01, and the minimum wage is one national figure. The English Labour Code we read stops at the 2017 amendments, so its articles were checked against Chambers Employment 2026 and Caspian Legal Center summaries; the current Azerbaijani-language text was not opened.

The minimum wage is also the base for an individual entrepreneur’s own contributions (see the contractor option below).
Employer contributions
For an employee in the private non-oil-and-gas sector, the case of an EOR hire, total employer on-cost is 16.7% of gross at AZN 85,000 a year and 14.6% at AZN 170,000.

Not in the total: work-injury cover, which employers insure with private carriers at rates that vary with industry risk (we found no rate for an office or IT employee), and sick pay for the first 14 days of incapacity.
The 22% rate applies in full only to the first AZN 200 of pay; the standard flat 22% is for the public sector and oil and gas.

On AZN 85,000 a year that leaves AZN 68,968 take-home: tax AZN 6,400, employee contributions AZN 9,632.
The income-tax rates rise to 5% in 2027 and 7% from 2028. A AZN 200 monthly relief applies to pay up to AZN 2,500; the Tax Service and Caspian Legal Center state it, but we didn’t open the Tax Code article.
Working hours and overtime
40 hours a week, 8 a day, five days with two days off; a six-day week is allowed by the nature of the industry (Chambers, checked 2026-10-10).
Overtime needs an employer order and the employee’s consent, up to 4 hours across two consecutive days; paid at least double, and time off can’t replace the pay.
Work on days off and holidays is paid at least double the daily rate; night hours carry an extra 20% of the hourly rate.
Annual leave and public holidays
At least 21 calendar days of paid leave; 30 for listed categories that include managers and experts. Seniority adds 2 days for 5-10 years, 4 for 10-15 and 6 above 15 (Chambers, checked 2026-10-10).
Unused leave is paid out on termination for any reason; a Constitutional Court ruling of 2026-02-18 says this covers basic and additional days (Caspian Legal Center, from a search extract).
2026 non-working days: 1-2 Jan; 20 Jan; 8 Mar; 20-24 Mar; 9 May; 27-28 May; 15 Jun; 26 Jun; 8 Nov; 9 Nov; 31 Dec, with some working days moved. The list is from a news report of the Cabinet decision (Operativ, checked 2026-10-10).
Probation
By agreement, up to 3 months, or 2 weeks if the contract runs 6 months or less. Either side can end it with 3 days’ written or electronic notice (Chambers, checked 2026-10-10).
No probation for under-18s, competitive-selection hires, pregnant women, women with a child under 3, first-job graduates and contracts up to 2 months.
Sources disagree for 2026. Caspian Legal Center says the failed-probation dismissal condition was abolished from 2026-01-16; Chambers (updated 2026-09-03) still lists it as an employer ground. We didn’t settle which is current (Caspian Legal Center, checked 2026-10-10).
Notice and severance
There is no dismissal at will: the Code lists closed grounds and the employer must justify the dismissal. Redundancy terms by length of service:
A trade-union member can be made redundant only with the union’s prior consent. An employee who resigns gives one month’s written notice (2017 text only).
A wrongful dismissal can bring average pay for the period of non-employment, legal costs and moral damages; mediation is a required first step.
13th salary and bonuses
Not mandatory: the Labour Code defines no 13th-month or performance bonus, and employers may grant rewards under internal rules (Chambers, checked 2026-10-10).
Mandatory benefits
Employer pays sick pay for the first 14 days; from day 15 the State Social Protection Fund pays 100%, 80% or 60% of reference earnings by length of employment, with at least 6 months of contributions required. Rates are from a 2022 ISSA profile and weren’t re-checked (ISSA, checked 2026-10-10).
Maternity leave is 126 calendar days (70 before and 56 after birth) paid from social insurance; fathers get 14 days of paid leave.
We found no statutory employer-funded private health or pension plan.
Work permits
A foreigner needs a work permit before working, issued by the State Migration Service within an annual quota set by the Cabinet; an employment or business visa is needed to obtain it (migration.gov.az, checked 2026-10-10).
Only an Azerbaijani legal entity, an individual entrepreneur, or a branch or representation of a foreign entity can apply, and it must employ the foreigner at its own workplace on a contract for the permit period. A foreign client without an Azerbaijani entity can’t be the applicant; an Azerbaijani EOR entity can.
Applications are refused if local labour can meet the demand, the quota is full, or documents or qualifications are lacking. Validity is 1 year or the contract term if shorter, extendable by up to 1 year; apply at least 30 days before expiry.

We didn’t find the 2026 quota number, or whether an EOR may place a foreigner who works remotely or for a client abroad.
By default wages are paid twice a month, at most 16 days apart; a delay caused by the employer adds 1% of the salary for each day (Labour Code art. 172 and 174, 2017 text not compared with later amendments). Vendors describe monthly payroll (migration.gov.az, checked 2026-10-10).
Is Employer of Record legal in Azerbaijan?
Grey area. Azerbaijani law has no category, licence or limit for an employer of record. The one firm we found with a view is the Caspian Legal Center, a Baku firm that sells the service itself, so treat it as an interested source. It writes that outsourcing and out-staffing (“provision of workforce” in the Tax Code) are non-regulated: neither the Labour Code nor the Civil Code regulates them. We found no regulator or Big Four statement on EOR. We didn’t open the Law on Employment or any licensing rules for private employment agencies, so we say we found nothing, not that nothing exists.
Who can employ. The firm says a business must have a legal entity, branch or representation in Azerbaijan to employ locals or foreigners, which is why an EOR is used. Since the 2026-01-16 amendments the Labour Code employer includes individuals without a legal entity, and “enterprise” includes a foreign entity’s branch or representation. Contracts are concluded electronically in the Ministry of Labour system (Caspian Legal Center, Caspian Legal Center on 2026 amendments, checked 2026-10-10).
Foreign staff. Concluding a labour contract with a foreigner without a permit is prohibited, and the permit applicant must be a local entity (migration.gov.az, checked 2026-10-10). Whether the “own workplace” wording limits placing an EOR-employed foreigner with a client isn’t clarified.
Art. 6 of the Code. As it read in 2017 it excluded foreigners employed by a foreign entity working at its operation in Azerbaijan; the 2026 amendment deleted words about the enterprise, which the firm says removes confusion for temporary assignments. What this means for a foreign company employing a resident directly isn’t stated anywhere we found. Contractor and other civil-law contracts are outside the Code.
Informal employment. It is monitored through a unified electronic resource, and mandatory employer payments are tracked through the tax service (Chambers, checked 2026-10-10). We found no penalty amounts in those sources; Playroll’s guide cites a fine of AZN 1,000 to AZN 3,000 per unregistered worker.
Risks for you as the client:
Tax audit. The firm says that in an audit of provider and client the model must be explained so staff don’t look like they work without an employment contract, which it calls “prohibited and harshly punished”. Single law-firm page; we found no audit practice or penalty amounts (Caspian Legal Center, checked 2026-10-10).
Work permits. An EOR can’t guarantee a permit for a foreign hire: it is refused if local labour can meet the demand or the quota is full, and runs for 1 year at a time.
Termination cost. Dismissal only on closed grounds, with notice and severance by service, trade-union consent for members, and court-ordered pay for wrongful dismissal. The EOR is the legal employer and normally passes these costs on under its contract.
Taxable presence. We found nothing on whether supervising an Azerbaijan-based EOR employee creates a taxable presence for you; this is a gap, not a finding.
Vendors describe their entity model globally. We separate what a vendor says about Azerbaijan from what we could verify. The taxpayer registry (taxes.gov.az) was unavailable to us and OpenCorporates returned no Azerbaijani data, so no entity below is checked against a register. A vendor statement shows a claim, not who employs your hire.

No provider states its own Azerbaijani entity; Skuad names a local partner without naming it. No entity was checked against a register. Source: vendor country pages, checked 2026-10-10.
Remote and Justworks aren’t counted: Remote’s Azerbaijan page lists only Contractor Management, and Azerbaijan isn’t on Justworks’ list of EOR countries. Providers with no Azerbaijan EOR page we could read, such as Oyster and Rippling, are left out too.
Thirteen of these 14 providers don’t say which company employs your hire in Azerbaijan, and Skuad doesn’t name its partner. Before signing, ask: “Which Azerbaijani company, with which taxpayer ID, will employ my hire, and will it apply for a work permit if they are a foreigner?”
How to choose an EOR in Azerbaijan
Is your hire a foreigner who needs a permit? The applicant must be a local entity, branch, representation or individual entrepreneur, and a foreign client without one can’t apply. Skuad says its local partner can sponsor work permits; ask every other vendor for written confirmation. Remote People says to plan 6-8 weeks if a permit is needed (Remote People, checked 2026-10-10).
Do you want a named employer? None of the 14 states its own Azerbaijani entity. Skuad names a local partner without a name, and Native Teams says “direct” without one. For the rest, ask for the entity name and taxpayer ID first.
Is price or speed the priority? Playroll starts from $399 and says 1-5 working days; Deel shows $599 plus a one-off $80 fee and says as little as 6 days; Safeguard Global says one to two weeks and publishes no price. Native Teams lists the lowest starting price, $99, a global figure. All timings are vendor claims.
Does the quote use 2026 rates? Several vendor pages still show a minimum wage of AZN 345, 300, 105 or 60 and pre-2026 tax rules (see the section on numbers vendors haven’t updated). Ask for a cost breakdown at today’s rates, including how accident insurance is priced.

What it costs to employ someone in Azerbaijan through an EOR
Employer cost is three contributions, two of them tiered. The examples assume an EOR entity with a large payroll employing an office or IT employee in the private non-oil-and-gas sector on an open-ended contract, with no 13th salary. Gross pay is AZN 85,000 and AZN 170,000 a year (USD 50,000 and USD 100,000 at 1 USD = 1.7000 AZN, CBAR, 2026-10-09).
Employer contributions only, before the EOR’s own fee. Work-injury insurance, employer-paid sick pay for the first 14 days, leave accruals and severance are not included. Source: taxes.gov.az and PwC, checked 2026-10-10.

Social insurance AZN 1,214 + 11% of the pay above AZN 8,000 = AZN 22,708; unemployment 0.5% = AZN 850; medical = AZN 1,300
Source: taxes.gov.az, PwC, checked 2026-10-10. Monthly pay is annual gross divided by 12.
Same AZN 85,000 salary every year. Social insurance (AZN 12,918) and unemployment (AZN 425) were flat; medical insurance was AZN 850 in 2021 at a 1% rate, AZN 1,700 from 2022 and AZN 875 in 2026 after the AZN 2,500 threshold. Source: State Tax Service, APA, checked 2026-10-10.
The EOR’s own fee is on top of the above. Per month, where a provider prices Azerbaijan itself: Playroll from $399, Skuad $549 ($499 on a 12-month commitment), Deel $599, Atlas from $599. The rest are global list prices: Native Teams from $99, RemoFirst, Remote People and Boundless from $199, Pebl $399, Multiplier Core $459 billed annually, Borderless AI $579, Rivermate $319-639. G-P’s price wasn’t confirmed and Safeguard Global publishes none.
Hidden costs, where published: Deel’s Azerbaijan page lists a one-off $80 “Mandatory Wet Ink Employment Agreement Handling Fee” and estimates employer cost at 16.6%-25.1%, including a 0.60% “Employer Liability Cost” (Deel, checked 2026-10-10). No vendor publishes a deposit, minimum term or termination fee for Azerbaijan; where a field is blank, treat it as unpublished, not zero. For a foreigner, add the state work-permit fee, AZN 350 to AZN 1,400.
When you don’t need an EOR
A foreign client with no Azerbaijani entity can’t apply for a work permit itself. Whether an EOR may place a foreigner who works for a client abroad isn’t addressed by the sources we found. Source: State Migration Service, checked 2026-10-10.
A genuinely independent contractor. Someone who isn’t under your direction and serves their own clients. See how to pay contractors in Azerbaijan and our hiring guide. The usual form is an individual entrepreneur paying 20% income tax on income after documented expenses, social insurance of 2% of income (at least AZN 60 and at most AZN 400 a month) and medical insurance of AZN 16 a month, per a 2025 State Tax Service brochure; we didn’t read the 2026 law text. The 2% simplified tax probably doesn’t fit a contractor whose only client is a foreign company, because the brochure counts invoices to non-residents toward a 30% cap; a written view from the Tax Service wasn’t found. Relabelling a directed role as a contract is contractor misclassification.
Your own Azerbaijani entity. The route when you hire foreigners regularly: the entity, branch or representation applies for each permit and files its foreign-staff quota report in the spring before the quota year.
Direct employment from abroad. The Labour Code employer is an enterprise, a branch or representation, or an individual running a business, and we found nothing on a foreign company employing a resident directly without one. The tax and permanent establishment position of a foreign client wasn’t researched, so check it with Azerbaijani counsel.
What changed in 2026
2026-01-01 - The seven-year personal income-tax relief ended: pay up to AZN 8,000 a month was exempt through 2025. The new scale is 3% up to AZN 2,500, AZN 75 + 10% to AZN 8,000 and AZN 625 + 14% above, and the AZN 200 relief stays for pay up to AZN 2,500 (taxes.gov.az).
2026-01-01 - Social insurance above AZN 8,000 a month falls from a combined 25% to 21%: employer AZN 1,214 + 11% of the excess. Rates up to AZN 8,000 are unchanged.
2026-01-01 - Medical insurance threshold lowered from AZN 8,000 to AZN 2,500; employer and employee each pay 2% up to it and 0.5% above. For pay between AZN 2,500 and AZN 8,000 the combined rate falls from 4% to 1% (APA).
2026-01-16 - Labour Code amendments take effect: remote work defined, the scope rule for foreigners employed by foreign entities changed, “employer” widened to individuals without a legal entity, fixed-term contracts allowed for foreigners on a work permit, and the failed-probation dismissal condition removed according to Caspian Legal Center (Caspian Legal Center).
2026-02-18 - The Constitutional Court rules that full compensation for unused basic and additional leave is due on any termination (Caspian Legal Center, from a search extract).
2027-01-01 - Second step of the legislated phase-in: income tax 5% up to AZN 2,500, AZN 125 + 10% to AZN 8,000, AZN 675 + 14% above; 7%, AZN 175 and AZN 725 from 2028-01-01.
Numbers vendors haven’t updated
Minimum wage. Multiplier’s page gives AZN 105, Remote’s country page AZN 300, and G-P and one Playroll page AZN 345; Borderless AI’s page shows AZN 60 with an editor’s note to double-check. It has been AZN 400 since 2025-01-01 (APA, checked 2026-10-10).
Income tax. Deel’s page gives a 0%-14% progressive scale and Borderless AI a flat 14%. The 0% band ended on 2025-12-31 and the 2026 scale starts at 3% (taxes.gov.az, checked 2026-10-10).
Medical insurance. Deel’s page gives 0.5% up to AZN 8,000 a month and 2% above. The 2026 rule is 2% up to AZN 2,500 and 0.5% above (APA, checked 2026-10-10).
Social insurance. Playroll’s worked example applies 22% to a whole AZN 4,000 salary. The 22% applies to the first AZN 200; 15% applies above it up to AZN 8,000 (PwC, checked 2026-10-10).
How we built this page
Country rules and vendor data were collected and checked on 2026-10-10, from the State Tax Service, State Migration Service, PwC, Chambers, Caspian Legal Center, the Central Bank of Azerbaijan and vendor pages. The English Labour Code we read stops at the 2017 amendments, so articles were cross-checked against Chambers and Caspian Legal Center, and the Tax Code and the current Labour Code text weren’t opened. The taxpayer registry wasn’t available to us, so no entity is checked against a register: where a vendor names a partner or describes its model, we report it as its statement, and the rest are recorded as not disclosed. The order puts the vendor that names a local partner first, then those with the most Azerbaijan-specific detail. Nobody pays for placement on this page.
Frequently asked questions
How much does an Employer of Record cost in Azerbaijan?
Two layers. Statutory employer contributions are AZN 14,218 (16.7%) on an AZN 85,000 salary and AZN 24,858 (14.6%) on AZN 170,000, before accident insurance, which we couldn't price. The EOR fee is separate: published starting prices run from $99 to $639 per month, and $399 to $599 where a provider prices Azerbaijan itself.
Is Employer of Record legal in Azerbaijan?
It is a grey area. The law has no EOR category, licence or limit. The Caspian Legal Center, a Baku firm that sells the service, calls staff outsourcing unregulated but warns that a tax audit will ask you to explain the model. We found no regulator or Big Four statement on EOR.
Which is the best Employer of Record in Azerbaijan?
It depends on what you weight. None of the 14 providers confirms its own Azerbaijani entity. Skuad says a local partner can sponsor work permits without naming it, and the other 13 don't name an Azerbaijani entity. Ask each for the company name and taxpayer ID before signing.
What is the cheapest Employer of Record in Azerbaijan?
Native Teams lists the lowest starting price, $99 a month, but it is a global price. Where a provider prices Azerbaijan itself, Playroll starts from $399, Skuad shows $549 and Deel $599. Deel adds a one-off $80 fee. No vendor publishes a deposit or termination fee for Azerbaijan.
What is the difference between an EOR and a contractor in Azerbaijan?
An EOR employs the person under the Labour Code, with notice, severance and leave, and you direct the work. A contractor is an individual entrepreneur who invoices you; the Code doesn't apply to civil-law contracts. Relabelling a directed role as a contract risks misclassification. See our [EOR vs PEO](/blog/eor-vs-peo/) comparison.
Can an EOR sponsor a work permit in Azerbaijan?
Yes, if it is a local legal entity. Only an Azerbaijani entity, branch, representation or individual entrepreneur can apply, within an annual quota, so a foreign client without one cannot. The state fee runs from AZN 350 to AZN 1,400 by speed and term, and an application is refused if local labour can meet the demand.
What is the minimum wage in Azerbaijan?
AZN 400 a month, set by a presidential decree of 2024-12-23 from 2025-01-01 and unchanged in 2026. It was AZN 345 from 2023 and AZN 300 from 2022. There are no regional or sector differences. Some vendor pages still show AZN 345, 300, 105 or 60.
How long does it take to hire through an EOR in Azerbaijan?
Vendors claim days: Deel says as little as 6 days and Playroll 1-5 working days, and Safeguard Global says one to two weeks. These are vendor claims. For a foreigner the work permit is a separate step: the state fee table lists 10, 15 or 20 working days, and Remote People says to plan 6-8 weeks.
