Employer of Record in Romania: your company, the EOR entity in Romania and your hire

Employer of Record is lawful in Romania only through a licensed route. Romania has no EOR statute; the regime that fits is the temporary work agent (agent de muncă temporară) of Labour Code arts. 88-102: an entity authorised by the Ministry of Labour, with a financial guarantee, placing a worker with a client for a task of a temporary nature. A mission may last 24 months, with extensions up to 36 in total (legeaz.net, checked 2026-10-07). Romanian law firms we found don’t write about EOR.

Cost has two layers. Employer contributions are 2.25% of gross, with no ceiling: RON 5,400 on a RON 240,000 salary (PwC, checked 2026-10-07). The EOR fee comes on top: list prices in our table run from $99 to $699 per month.

What sets Romania apart is a public register. The Ministry of Labour’s national register of authorised temporary work agents, as of 2026-09-30, lists four of the 19 providers by name: Remote, Pebl, G-P and Boundless (mmuncii.gov.ro, checked 2026-10-07). The others are not found by name or tax ID, a limit of a name search, not a finding of non-compliance.

An Employer of Record suits a hire you direct, an EU, EEA or Swiss national, within the 36-month mission cap. A non-EU hire raises a separate question: who files the visa. An independent specialist can work as a contractor; see also paying contractors in Romania.

Employing someone in Romania: key facts

Romania sets one national minimum wage and one employer contribution of 2.25% of gross. Notice, probation and overtime follow the Labour Code. Everything below is statutory unless marked as a press or law-firm source.

Minimum wage

National rate, no regional rates. Higher sector rates exist for some sectors, such as construction, and do not apply to office or IT work. The rate is also the floor for a temporary work contract (Labour Code art. 96(2)) (legeaz.net, checked 2026-10-07).

We did not open the decision text; the number and the hourly figure come from press coverage, and Eurostat shows RON 4,325 for 2026-S2.

Employer contributions

The employer pays one contribution. The employee’s contributions and income tax are withheld from gross and are not employer cost (PwC, checked 2026-10-07).

  • CAM replaced the earlier employer contributions (unemployment, sick-leave fund, work-accident insurance, wage-claims guarantee fund) on 2018-01-01 under OUG 79/2017 (anaf.ro, checked 2026-10-07). We found no change to the employer rate in 2021-2026, so there is no history chart.
  • Not in the 2.25%: the disability quota (employers with 50 or more employees must employ 4% disabled persons or pay a levy) and employer-paid sick-pay days. We did not confirm the employer’s share of sick pay.
  • The Fiscal Code article behind CAM (art. 220^3) was not opened; the rate is from PwC and ANAF guides.

Working hours and overtime

  • Standard week: 40 hours, 8 a day. Maximum 48 hours a week including overtime, averaged over 4 months, no opt-out (Labour Code arts. 112(1), 114) (legeaz.net, checked 2026-10-07).
  • Weekly rest: 48 consecutive hours, usually Saturday and Sunday.
  • Overtime needs the employee’s consent, except force majeure or urgent accident-prevention work (art. 120(2)) (legeaz.net, checked 2026-10-07).
  • Overtime pay: paid time off within the following 90 days, otherwise a premium of at least 75% of base salary (DLA Piper, checked 2026-10-07). A copy of the Code labelled 2020 says 60 days; we did not read the amended article.

Annual leave and public holidays

  • Annual leave: at least 20 working days; the contract sets the actual length. Public holidays and paid days off under a collective agreement are not counted in it (art. 145) (legeaz.net, checked 2026-10-07).
  • Public holidays: 17 legal days off a year (DLA Piper, checked 2026-10-07). In 2026 the list is 1-2 Jan, 6-7 Jan, 24 Jan, 10 Apr (Good Friday), 12-13 Apr (Orthodox Easter), 1 May, 31 May (Pentecost), 1 Jun, 15 Aug, 30 Nov, 1 Dec and 25-26 Dec (capital.ro, checked 2026-10-07).
  • Five of those dates fall on weekends in 2026 (24 Jan, 12 Apr, 31 May, 15 Aug, 26 Dec), so 17 counts entries, not working days lost. The calendar is a press source; Labour Code art. 139 was not opened.

Probation

  • Up to 90 calendar days for execution positions and 120 for management positions. Either side may end it by written notice, with no notice period or reasons (art. 31) (legeaz.net, checked 2026-10-07).
  • No new probation if the same employer rehires the person for the same job within 12 months (EY Romania, checked 2026-10-07).
  • A temporary work contract has shorter caps (art. 97):

Notice and severance

  • Employer notice: at least 20 working days when the employer dismisses for reasons unrelated to the person (arts. 61, 65-66, 75(1)). No notice during probation. DLA Piper states payment in lieu of notice is not permitted, citing High Court precedent (legeaz.net, DLA Piper, checked 2026-10-07).
  • Employee resignation notice: as agreed, at most 20 working days for execution roles and 45 for management (art. 81(4)). We read art. 81 in the 2020 copy and did not check later amendments.
  • Severance: none by statute for individual dismissal; payments exist only if the individual contract or the collective agreement provides them (DLA Piper, checked 2026-10-07).
  • A temporary worker dismissed before the end of a mission for non-disciplinary reasons gets the ordinary dismissal protections (art. 100). Collective dismissal rules were not read.

13th salary and bonuses

Not confirmed. We found no Labour Code provision and no law-firm or official source on a statutory 13th salary, so we do not state one.

Mandatory benefits

  • No universal employer-paid benefits in the Labour Code beyond contributions; state pension and health cover run through the employee’s CAS and CASS (DLA Piper, checked 2026-10-07).
  • Sick leave: the employer pays the first days and the health insurance fund the rest. The employer’s share and rates were not confirmed.
  • Meal vouchers are optional.

Work permits

  • EU, EEA and Swiss citizens need no work permit; registration applies for stays over 3 months (DLA Piper, checked 2026-10-07).
  • Non-EU nationals: from 2026-08-08 all work visas go through the WorkinRomania.gov.ro platform under OUG 32/2026 (igi.mai.gov.ro, checked 2026-10-07).
  • Highly qualified workers and EU Blue Card holders (D/AM1 long-stay visa): the employer files a single request itself, with a contract of at least 6 months or indefinite, registered in REGES-Online, a salary at least the average gross wage and a labour-office certificate that no local worker is available.
  • Permanent, seasonal and cross-border workers (D/AM2): through a licensed placement agency or an authorised employer, only for occupations on the shortage list.
  • A temporary work agency cannot hire non-EU workers for the benefit of user companies under the authorised-employer route (OUG 32/2026 art. 11(5), art. 18(l)).

Currency and payroll

RON. Salary is paid at least once a month, on the date set in the contract, and bank transfer is allowed (art. 166(1)) (legeaz.net, checked 2026-10-07). The employer files the monthly payroll declaration D112 and pays contributions and withholding tax by the 25th of the following month (PwC, checked 2026-10-07). National Bank of Romania rate on 2026-10-06: 1 USD = 4.7616 RON (bnr.ro, checked 2026-10-07).

Restricted. Romania has no EOR statute. The one lawful way for a third party to employ people who work under another company’s direction is the temporary work agent regime of Labour Code arts. 88-102: an entity authorised by the Ministry of Labour that employs the worker and places them with the client for a precise, temporary task (legeaz.net, checked 2026-10-07). We found no Romanian law-firm source that discusses EOR as such, or the consequences of running the model without authorisation, so the verdict is a reading of the Code. We read arts. 88-102 in a copy labelled 2020 and in a Labour Inspectorate summary; the current consolidated text could not be opened. See also the Employer of Record glossary entry.

The rules that matter to a client:

  • Authorisation. The Ministry of Labour authorises, on a proposal from the territorial payments and social inspection agencies (AJPIS). Conditions under Government Decision 1256/2011, as summarised by the Labour Inspectorate: a legal entity whose main object is temporary staffing, no debts to state or local budgets, no labour, commercial or tax contraventions in the previous 24 months, and a financial guarantee at a Romanian bank equal to 25 national gross minimum wages plus contributions. At RON 4,325 the wage part alone is RON 108,125 (our arithmetic). No fee; a decision within 30 days; valid 2 years, renewable (inspectiamuncii.ro, checked 2026-10-07).
  • Register. Authorised agents are entered in the Ministry’s national register; the March 2026 edition is at mmuncii.gov.ro, and the one we used is dated 2026-09-30.
  • Duration. Use only for a precise task of a temporary nature, never to replace an employee on strike. A mission may be set for at most 24 months; successive extensions may not bring the total above 36 months (arts. 89-90, 93). One contract can cover several missions only within the same 36-month cap; the agent may instead keep the worker on an open-ended contract between missions (art. 95) (legeaz.net, checked 2026-10-07). The law does not say what happens when the 36 months run out.
  • Equal treatment. Pay for a mission may not be lower than that of the client’s employee doing the same or similar work, and the worker has access to the client’s services and facilities on the same terms (art. 92). The client’s internal regulation and collective agreement apply during the mission (art. 101). A clause banning the client from hiring the worker after the mission is void (art. 91) (legeaz.net, checked 2026-10-07).
  • Contract. A written employment contract between agent and worker; the agent pays salary and all taxes and contributions and may not charge the worker a fee (arts. 94, 96, 102). It is registered in REGES-Online no later than the working day before work starts (legeaz.net, checked 2026-10-07).
  • Foreign providers. The regime requires a legal entity constituted under Romanian law. We found no provision that lets an agency from another EU state place workers with a Romanian client without a Romanian authorisation, and none that forbids it. Treat a foreign EOR with no Romanian licensed entity as unconfirmed, not as lawful.
  • Non-EU workers. OUG 32/2026 bars an employer authorised on the D/AM2 route from hiring foreigners for other employers, with a fine of RON 5,000-10,000 per placed foreigner. The ordinance does not name the temporary work agent and does not repeal arts. 88-102. Whether a licensed agency may be the applicant for a D/AM1 or EU Blue Card hire placed with a client was not found addressed. We did not read the law approving the ordinance, which Parliament amended after the Senate vote (igi.mai.gov.ro, checked 2026-10-07).
  • Contractor structures. DLA Piper notes that independent contractor arrangements risk being reclassified as employment (DLA Piper, checked 2026-10-07).

Risks the client carries:

  • Joint payment liability, even with a licensed agent. If the agent does not pay wages, taxes and contributions within 15 calendar days after they fall due, the client must pay them on the worker’s request and takes over the worker’s claim against the agent (art. 96(4)-(5)) (legeaz.net, checked 2026-10-07).
  • Workplace conditions. During the mission the client is responsible for working conditions and health and safety, and must tell the agent at once of any work accident or occupational illness (arts. 92(2), 98) (legeaz.net, checked 2026-10-07).
  • Fine for work without a contract. Receiving a person to work without an individual employment contract is fined RON 40,000 per person since 2025-12-18 (Law 239/2025), with a cap of RON 1,000,000 on the total fines for one employer (inspectiamuncii.ro, checked 2026-10-07). We found no source saying it would be applied to the client of an EOR that is not on the register; it is the general sanction for work without a contract.
  • Registration exposure for employers of non-EU nationals. A recent sanction under Labour Code art. 260(1)(e) or (e^1), or arts. 264-265, blocks registration on the WorkinRomania platform; contraventions under the ordinance run to RON 15,000-40,000 for employers (igi.mai.gov.ro, checked 2026-10-07).

Who actually employs your hire in Romania

We compared 19 providers with the Ministry of Labour’s national register of authorised temporary work agents (state at 2026-09-30, published 2026-10-05), by name and by tax ID (CUI) of each Romanian company we found. Four are in it. We read the register as a text copy of the PDF, with table rows split over several lines, so check permit dates against the original. “Not found by name or tax ID” is not non-compliance: a vendor may use a differently named entity or a partner. Company details beyond the register come from free mirrors of the trade register (ONRC), where the owner is hidden, so a company is tied to a vendor by name only.

All checked 2026-10-07. “Own entity (in register)” means the Romanian company is in the Ministry’s register of temporary work agents; “Own entity (vendor says)” rests on the vendor’s own statement, with no register entry found. Rippling is not in the table: its country catalog lists Romania under contractors only, with no employee link, so we conclude it offers no EOR in Romania; that is a reading of the catalog, not a vendor statement.

Eleven of the 19 don’t say who the Romanian employer is, and one works through an unnamed partner. That matters because the register is the only public sign we found of the authorisation Romanian law asks for, and seven providers say or show they have their own entity while three of them are not in it. Before signing, ask: “Which Romanian company signs my employee’s contract, under which Ministry of Labour authorisation number, and what happens when the mission reaches 36 months?”

How to choose an EOR in Romania

Want a visible legal basis? Remote, Pebl, G-P and Boundless are the four in the register. Of them, Remote also names its Romanian entity in its contract terms and says it owns it; Boundless describes its route as a licensed local temporary work agency. Ask whichever you shortlist for the current authorisation number, because we read the register as of 2026-09-30 only.

Hiring a non-EU national who needs a work visa? Two routes differ. For D/AM2, an authorised employer may not hire foreigners for other employers, fine RON 5,000-10,000 per person. For D/AM1 or the EU Blue Card the employer files the request itself, and we found no rule that bars an agency. Ask the provider in writing who the applicant would be and under which route. Skuad’s page puts onboarding at two to four weeks for EU nationals, and Borderless AI’s sample timeline runs about 45-50 days with a work permit step (vendor claims).

Expect to keep the hire for more than three years? The 36-month cap applies to a mission, and the law does not say what follows. The agent may keep the worker on an open-ended contract between missions, and the worker may sign directly with the client after a mission (art. 99). Ask how the provider structures a long hire, or weigh your own entity.

Price against completeness? Among prices on a Romanian page, Skuad is lowest at $249 per month, then Deel from $599 and Remote $699. Of the four in the register, Boundless lists from $199, Pebl $399, G-P from $599 and Remote $699 (global list prices except Remote). Price tells you nothing about the legal basis; compare it after you have the answer to the question above.

What it costs to employ someone in Romania through an EOR

The EOR is a large-payroll employer, with an office or IT employee on an ordinary open-ended contract in normal working conditions. Gross pay is RON 20,000 and RON 40,000 a month, about USD 50,000 and USD 100,000 a year at the National Bank of Romania rate of 1 USD = 4.7616 RON on 2026-10-06 (bnr.ro, checked 2026-10-07).

The employer rate was 2.25% in every year 2021-2026, so a history chart would show a flat line. The end of the IT income-tax exemption in 2025 changed the employee’s net pay, not the employer’s cost.

Not included: the disability quota levy for employers with 50 or more employees, employer-paid sick-pay days, meal vouchers and other optional benefits, and the EOR fee. Employee CAS 25%, CASS 10% and income tax 10% are withheld from gross and are not employer cost. There is no confirmed 13th salary to add.

The EOR’s own fee comes on top. Three vendors show a price on a Romanian page: Skuad from $249 per month, Deel from $599 (management fee) and Remote $699. Global list prices, where no Romanian figure exists, run from $99 (Native Teams) to $699 (Oyster) per month; the per-vendor figures are in the table above. Justworks, Safeguard Global and Papaya Global publish none that we could find.

Hidden costs, where published:

  • Oyster says “No hidden fees. No termination charges.” (oysterhr.com, checked 2026-10-07).
  • Multiplier says “There are no per-payroll charges, no setup fees, and no variable pricing based on salary level” (usemultiplier.com, checked 2026-10-07).
  • Playroll shows “No Minimum Commitments” (playroll.com, checked 2026-10-07).
  • For every other vendor, setup fee, deposit, minimum term and termination fee are not published for Romania. Treat a blank as unpublished, not zero.

When you don’t need an EOR

Decision tree: if the person does not work under your direction, engage them as a contractor. If they do and need a non-EU work visa, get the filing route in writing. Otherwise a licensed-agent EOR fits, with a 36-month mission cap.
A role that is employment should not be relabelled as a contract. A mission may last at most 24 months, 36 with extensions (Labour Code art. 90). For a non-EU hire, an authorised employer on the D/AM2 route may not hire for other employers; for D/AM1 and the Blue Card no bar on agencies was found.   • A genuinely independent contractor. If the person sets their own hours and tools and can serve other clients, a contract is closer to the real relationship.   • Your own Romanian entity. The route to weigh when the hire will outlast the 36-month mission cap. Vendor estimates for setting one up differ: Skuad’s page puts registration of an SRL at RON 78,690 to RON 131,150 and 3-6 months (skuad.io), while Playroll’s guide shows an entity setup time of 4-8 weeks (playroll.com, checked 2026-10-07). These are vendor figures, not ours.

What changed in 2026

  • 2025-01-01: the income-tax exemption for IT employees (Fiscal Code art. 60 pt. 2, up to RON 10,000 gross a month) was removed by OUG 156/2024 for income from January 2025, together with the equivalent reliefs in construction and agri-food. IT staff are taxed like other employees. Employer CAM, 2.25%, was not affected (kpmg.com, checked 2026-10-07).
  • 2025-12-18: Law 239/2025 raised the fine for receiving a person to work without an employment contract to RON 40,000 per person and capped total fines for one employer at RON 1,000,000. One press source puts the start at 2026-01-01 (inspectiamuncii.ro, checked 2026-10-07).
  • 2026-04-27: OUG 32/2026 on foreigners’ access to the labour market entered into force: the WorkinRomania.gov.ro platform, a shortage-occupation list, placement agencies authorised by ANOFM with a financial guarantee of EUR 75,000 for up to 250 placed foreigners, a ban on authorised employers hiring for other employers, and a single request in place of the employment authorisation (igi.mai.gov.ro, checked 2026-10-07). Parliament amended parts of it in the approving law, which we did not read.
  • 2026-06-07: the EU Pay Transparency Directive transposition deadline passed without a Romanian law. A Senate bill was filed on 2026-06-17 and the Legislative Council gave a negative opinion on 2026-06-26; first gender pay gap reports for employers with 150 or more employees are expected in June 2027. Not law (legal500.com, checked 2026-10-07).
  • 2026-07-01: the national minimum gross wage rose from RON 4,050 to RON 4,325 a month. For employees paid exactly the minimum, press coverage says the tax-free amount falls from RON 300 to RON 200 and the employer’s total cost is RON 4,418 (startupcafe.ro, checked 2026-10-07).
  • 2026-08-08: the new visa system took over; the old one accepted applications until 2026-08-07 (birisgoran.ro, checked 2026-10-07).
  • 2026-09-30: the state of the Ministry of Labour register of temporary work agents used on this page, published 2026-10-05 (mmuncii.gov.ro, checked 2026-10-07).

Numbers vendors haven’t updated

  • Minimum wage. The rate in force is RON 4,325 from 2026-07-01. Deel’s and Multiplier’s Romania pages give RON 4,050, and RemotePass, Atlas HXM and Borderless AI give RON 3,700. Remote’s page gives RON 4,325 (deel.com, usemultiplier.com, remotepass.com, atlashxm.com, hireborderless.com, remote.com, checked 2026-10-07).
  • Employer cost. The statute gives 2.25%. Deel’s page says “employer cost is generally estimated at 2.85% of the employee salary” and lists extra items; Oyster gives “approximately 6.25% of gross salary”; Playroll gives 2.25% (deel.com, oysterhr.com, playroll.com, checked 2026-10-07).
  • Probation. The Code gives up to 90 days, 120 for management. Skuad’s page says up to 30 days for operational roles and 90 for management; Multiplier’s page gives 30 and 90 in one place and 90 and 120 in another (skuad.io, usemultiplier.com, checked 2026-10-07).

How we built this page

Facts were collected and checked on 2026-10-07 against Romanian legislation and Labour Inspectorate summaries, Eurostat, ANAF, PwC and law-firm material; the Labour Code was read in a copy labelled 2020. We checked the Ministry of Labour register of temporary work agents (state at 2026-09-30) for each vendor by name and by CUI, reading its PDF as text, and used trade-register mirrors for company details; where a vendor operates through a differently named entity or a partner, our search cannot see it. Vendors are ordered with registered and stated own entities first, then partners, then those that do not disclose; no vendor pays for placement.

How much does an Employer of Record cost in Romania?

Two layers. Employer contributions are 2.25% of gross with no ceiling: RON 5,400 on RON 240,000 a year and RON 10,800 on RON 480,000. The EOR fee is on top: list prices in our table run from $99 to $699 per month, and three vendors show a price on a Romanian page (Skuad from $249, Deel from $599, Remote $699).

Is Employer of Record legal in Romania?

Only through a licensed route. Romania has no EOR statute; the regime that fits is the temporary work agent under Labour Code arts. 88-102, which needs Ministry of Labour authorisation and a financial guarantee. A mission lasts up to 24 months, 36 with extensions. We found no Romanian law-firm text on EOR as such, so the verdict is a reading of the Code.

Which EOR in Romania is on the temporary work agents register?

Four of the 19 providers: Remote (Remote Technology RO SRL), Pebl (Velocity Global Romania SRL), G-P (Globalization Partners RO SRL) and Boundless (Boundless Payroll RO SRL), in the Ministry of Labour register as of 2026-09-30, published 2026-10-05. We read a text copy of the PDF, so check the original. Not found by name or tax ID is not non-compliance: a vendor may use a differently named entity or a partner.

What is the cheapest EOR in Romania?

Among prices shown on a Romanian page, Skuad is lowest at $249 per month, then Deel from $599 and Remote at $699. Global list prices go lower, to $99 at Native Teams. Of the four providers in the register, Boundless lists the lowest price, from $199 a month globally. Price says nothing about the legal basis: ask who employs your hire first.

What are the risks of hiring through an EOR in Romania?

With a licensed agent, the client must pay unpaid wages, taxes and contributions on the worker's request if the agent has not paid within 15 calendar days. Receiving a person to work without an employment contract is fined RON 40,000 per person, capped at RON 1,000,000 per employer since 2025-12-18. We found no source saying whether that fine would be applied to a client of an unlicensed EOR.

Should I hire a contractor instead of using an EOR in Romania?

Can an EOR in Romania sponsor a work visa?

EU, EEA and Swiss nationals need no work permit. For non-EU workers, OUG 32/2026 bars an employer authorised on the D/AM2 route from hiring foreigners for the benefit of other employers, with a fine of RON 5,000-10,000 per foreigner. For a D/AM1 or EU Blue Card the employer files the request itself, and we found no rule on whether a temporary work agency may do so.

Can I keep an EOR employee in Romania for more than three years?

A temporary work mission may be set for at most 24 months, with extensions up to 36 months in total. The law does not say what happens when the 36 months run out, or whether successive missions at the same client can be chained. Ask the provider in writing how it structures a longer hire.
