Kyrgyzstan is an EAEU member with a genuinely light-touch tax system for solo operators and a standout High-Tech Park regime for anyone with real export volume. For a foreign hirer the engagement is simple and cheap when independence is real — and the compliance-enforcement pressure is far lower than in the EU.
Legal form and tax
Most solo contractors register as an individual entrepreneur (жеке ишкер / ИП) and sit on the unified (single) tax:
- Unified tax: 2% of cashless turnover (4% on cash) for software development and 4% (6% on cash) for most other services (zakon.kg, checked 2026-09-28).
- A private individual who doesn’t register pays a flat 10% income tax (annual return).
- Patents still exist — the Tax Code, as amended to 6 August 2026, keeps a patent regime (Chapter 56) for a list of activities (spinform.ru, checked 2026-09-28).
For serious export volume the High-Tech Park (HTP) is the standout: a resident — an LLC (OsOO) or an individual entrepreneur (htp.kg, checked 2026-09-28) — pays 0% profit tax, 0% VAT, 0% sales tax, a flat 5% payroll income tax and 1% of revenue to the HTP Directorate, provided the business is export-oriented, earning from foreign customers. November 2024 amendments made the regime indefinite (htp.kg; timesca.com, checked 2026-09-28) — the single biggest planning fact for IT. The contractor handles their own registration and tax; a foreign client withholds nothing.
Classification
Kyrgyzstan does not run aggressive US/EU-style contractor-vs-employee reclassification, and public enforcement against foreign clients is minimal. The risk is modest — but a clean services contract (deliverables, no fixed hours, contractor’s own tools) is still worth having, both for tax substance and to keep the relationship genuinely independent.
Contract and IP
- A written services agreement scoped to deliverables.
- IP assignment in writing. Under Kyrgyz copyright law (Law No. 6 of 1998), the exclusive right does not transfer automatically for an independent contractor — assign economic rights explicitly. The employer default applies only to employees’ service works.
Taxes and paperwork
Pay gross against invoices; no Kyrgyz withholding for a foreign client. US payers collect a W-8BEN and file no 1099; services performed in Kyrgyzstan are foreign-source. There is no dedicated US–Kyrgyzstan treaty (the inherited 1973 USSR treaty is rarely relevant to service fees).
