How to pay contractors in Germany

A foreign company pays a German contractor against an invoice, in EUR over SEPA to the contractor’s IBAN, from its own bank or through a payout platform. The transfer is the easy part. What decides the tool is how you document the engagement, because in Germany the expensive question is whether the contractor is really an employee.

That question is Scheinselbstständigkeit (false self-employment). The German Pension Insurance (DRV) decides it on the overall picture, with work under instructions and integration into the client’s organisation as the markers of employment (§7 SGB IV, checked 2026-09-28). If it finds employment, contributions are claimed up to four years back, 30 if they were withheld intentionally (§25 SGB IV, checked 2026-09-28). Being abroad does not put the client out of reach: an EU client carries employer obligations as if it were established in Germany (tk.de, checked 2026-09-28).

The rail itself is cheap. There is no currency control, and since 9 October 2025 euro-area banks must send SEPA Instant at the price of a standard transfer (ecb.europa.eu, checked 2026-09-28). A Freiberufler with several clients is well served by a bank transfer or Wise. How to choose: four questions for paying a contractor in Germany

1. Would the DRV see this engagement as employment? The markers in the law are work under your instructions and integration into your organisation (§7 SGB IV, checked 2026-09-28). Fixed hours, your manager assigning daily tasks and no other clients point one way. Deliverables, own tools and schedule, several clients point the other.

Dependence on one client has its own threshold. A self-employed person without employees who works long-term essentially for one client must pay into the state pension scheme (§2 SGB VI); the government’s start-up portal puts that at five-sixths of business income from one client (existenzgruendungsportal.de, both checked 2026-09-28). That is the contractor’s cost, and the same profile a status review examines.

If you are unsure, either party can ask the DRV for a binding status decision with form V0027. It is free, takes about three months on average and can be requested before work starts (deutsche-rentenversicherung.de, checked 2026-09-28). Filed within one month of the start, a finding of employment takes effect only from the decision date, provided the contractor consents and has health and pension cover (§7a(5) SGB IV, checked 2026-09-28).

If the engagement is genuinely independent: a transfer rail or contractor management platform. If you want someone else to hold the contract and reduce your misclassification risk: a Contractor of Record; read its liability clause, not the product name. 4dev acts as a Contractor of Record and is the contracting party for each contractor, which reduces reclassification risk. 2. Is your company in the EU or outside it? A reclassification bill reaches you either way. An EU employer without a German establishment must register and pay contributions as if established in Germany; it may let the worker handle payment but stays liable (tk.de, checked 2026-09-28). Where a foreign employer does not pay, the worker can be made to pay the full contribution and then holds a claim against the employer for its share (§28m SGB IV, checked 2026-09-28).

On VAT, an EU payer needs the contractor’s VAT ID and the reverse-charge wording “Steuerschuldnerschaft des Leistungsempfängers” on each invoice (§14a UStG, checked 2026-09-28). A payer outside the EU receives an invoice without German VAT, because the service is supplied where the client runs its business (§3a UStG, checked 2026-09-28).

If you are an EU payer: a platform that collects the VAT ID and a compliant invoice before the first payment. If you are outside the EU: VAT is simpler; the status question weighs the same.

3. What currency do you pay from? If you hold EUR in an EU account, pay by SEPA. Since 9 October 2025 euro-area banks must be able to send SEPA Instant, priced no higher than a standard transfer (ecb.europa.eu, checked 2026-09-28).

From USD, a SWIFT wire into a EUR account is converted at the receiving bank’s rate, and the bank may charge for the incoming wire: N26 takes €12.50 plus 0.1% on incoming SWIFT transfers of €150 or more, capped at €100, on most account types (support.n26.com, checked 2026-09-28). Wise showed USD 3.44 to send USD 1,000 to Germany from a Wise balance and USD 9.87 funded by bank transfer (wise.com, checked 2026-09-28).

If you already hold euros: SEPA from your own bank or any platform. If you pay from another currency: a provider that converts at a disclosed rate and pays out in EUR.

4. One contractor, or a team with documents per payment? Platform pricing is a percentage per payout or a monthly seat per contractor. At 3%, a percentage fee equals a $29 seat at about $967 a month, a $40 seat at about $1,333 and a $49 seat at about $1,633. Above those invoice totals the seat costs less on fees alone.

With one contractor, a contract, invoices and SEPA transfers are enough. With a team, matching them per person becomes monthly work, and that file is what you would hand over in a DRV status review.

If you pay one contractor and your accountant is happy with invoices: your bank or Wise. If you pay a team: a contractor platform with a document flow. Compare the field in the contractor payouts rating.

There is no currency control: the EU treaty prohibits restrictions on payments between member states and with non-EU countries (TFEU Art. 63, checked 2026-09-28). Banks still screen payments for sanctions and AML.

Freiberufler or Gewerbe. The law names engineers, architects, translators and other professions, plus scientific, artistic, writing and teaching work and “similar professions” (§18 EStG, checked 2026-09-28). Software developers and designers are not named, so their category is settled case by case. For you, it changes nothing on the invoice.

VAT. The standard rate is 19% (§12 UStG). A Kleinunternehmer charges no VAT if turnover was at most €25,000 last year and stays at most €100,000 this year (§19 UStG); services supplied abroad do not count toward that turnover (existenzgruendungsportal.de, all checked 2026-09-28). Either way, your invoice carries no German VAT.

Documents and tax on your side

Withholding. None. German wage tax is withheld by employers with a residence, seat, management, permanent establishment or permanent representative in Germany (§38 EStG, checked 2026-09-28); a self-employed contractor pays income tax by assessment, and you pay the invoice gross.

US payers. Collect Form W-8BEN from a Freiberufler or Gewerbetreibender and Form W-8BEN-E from a GmbH or UG. Pay for services is sourced where the work is performed, and foreign-source income paid to a non-resident is not subject to NRA withholding (irs.gov; irs.gov, checked 2026-09-28), so no 1099. The US–Germany treaty was signed on 29 August 1989; its 2006 protocol deleted the independent personal services article and moved professional services into business profits (irs.gov; 2006 protocol, Arts. III and VII, checked 2026-09-28). It matters only if the contractor works while in the US.

What to keep, per contractor:

  1. The signed services contract with scope, rate, currency and the usage rights you need.
  2. Each invoice; for EU payers, the contractor’s VAT ID, the reverse-charge wording and a VIES check.
  3. Proof of payment matching each invoice.
  4. W-8BEN or W-8BEN-E (US payers), and the DRV status decision if you or the contractor applied for one.

E-invoicing and a foreign client

The mandate covers B2B supplies between businesses established in Germany. Since 1 January 2025 they must be able to receive e-invoices; an email inbox is enough. The issuing transition ends on 31 December 2026, or 31 December 2027 for suppliers with prior-year turnover up to €800,000; Kleinunternehmer are exempt from issuing. Accepted formats include XRechnung and ZUGFeRD from version 2.0.1, while a plain PDF no longer counts as an e-invoice (bundesfinanzministerium.de FAQ, updated March 2026, checked 2026-09-28).

For a client without a German establishment none of this is an obligation, and a PDF invoice remains fine. A contractor whose software issues ZUGFeRD by default sends a PDF with embedded XML, which files like any PDF.

Where payments to Germany break

  • Reclassification after the fact. Contributions are claimed up to four years back, plus 1% per started month in late surcharges unless the debtor shows it could not have known (§24 SGB IV). The employee share can be deducted only from the next three salary payments (§28g SGB IV), so the client carries both shares. Withholding contributions is a crime carrying up to five years (§266a StGB, all checked 2026-09-28).
  • The contractor is billed instead of you. Where a foreign employer does not pay, §28m SGB IV lets the health insurance fund collect the full contribution from the worker, who can then claim the employer share from you. In July 2026 a Berlin-Brandenburg court suspended the employer-share part of such a demand on an Israeli company’s employee, because the fund had not shown why it chose her (L 4 KR 166/26 B ER, reported by sozialrechtsiegen.de, checked 2026-09-28).
  • Name mismatch on the payee check. Since 9 October 2025 euro-area banks warn the payer when the payee name and IBAN do not match (Bundesbank, checked 2026-09-28). A sole proprietor’s account is usually in their personal name, a GmbH’s in its registered name: use the name the bank holds.
  • USD sent to a EUR account. The receiving bank converts at its own rate and may charge a fee, so the contractor is short against a EUR invoice.
  • An EU payer’s invoice without VAT ID or reverse-charge wording. It does not meet §14a UStG; ask for a corrected one before paying.
  • Waiting for reform. A March 2026 labour ministry draft would add a “new self-employment” status tied to compulsory pension insurance; in June 2026 it was still in consultation, planned for 1 January 2028 (mittelstandsbund.de, checked 2026-09-28). What's the cheapest way to pay a contractor in Germany?

If you hold euros in an EU account, a SEPA transfer: since 9 October 2025 euro-area banks must offer SEPA Instant and cannot charge more for it than for a standard transfer (ecb.europa.eu, checked 2026-09-28). From USD, Wise showed USD 3.44 to send USD 1,000 to Germany from a Wise balance and USD 9.87 funded by bank transfer (wise.com, checked 2026-09-28). A 3% platform fee is USD 30 on the same amount and also covers the contract and documents.

Can I pay a contractor in Germany in USD?

Yes, by SWIFT, but a German contractor's account is normally in EUR, so the receiving bank converts at its own rate and may charge for the incoming wire. N26, for example, charges €12.50 plus 0.1% on incoming SWIFT transfers of €150 or more, capped at €100, on most account types (support.n26.com, checked 2026-09-28). Paying EUR against a EUR invoice avoids both.

Do I need to withhold tax when paying a contractor in Germany?

No. A German contractor pays their own income tax by assessment, and German wage tax withholding applies to employers with a residence, seat, management or permanent establishment in Germany (§38 EStG, gesetze-im-internet.de, checked 2026-09-28). US payers collect Form W-8BEN or W-8BEN-E; pay for work performed in Germany is foreign-source income, so no 1099.

What is Scheinselbstständigkeit and does it apply to a foreign client?

It is false self-employment: a contractor who works under your instructions and is integrated into your organisation is an employee for social security (§7 SGB IV). A foreign client is not exempt: an EU client must meet employer obligations as if established in Germany, and where a foreign employer does not pay, the health insurance fund can collect the full contribution from the worker, who then claims the employer share (§28m SGB IV).

How does the DRV status procedure (Statusfeststellungsverfahren) work?

The client or the contractor applies to the DRV Bund with form V0027. The procedure is free, takes about three months on average and can be requested before work starts (deutsche-rentenversicherung.de, checked 2026-09-28). If you apply within one month of the start and the DRV finds employment, it begins only on the decision date, provided the contractor consents and has health and pension cover (§7a(5) SGB IV).

Do I pay German VAT on a German contractor's invoice?

No, for a B2B service to a business abroad: the place of supply is where the client runs its business (§3a(2) UStG), so the invoice carries no German VAT. For an EU client it must show 'Steuerschuldnerschaft des Leistungsempfängers' and both VAT IDs, and you self-account in your country (§14a UStG). The German standard rate you would otherwise see is 19%.

Does Germany's e-invoicing mandate apply to invoices sent to a foreign company?

No. The mandate covers B2B supplies between businesses established in Germany; since 1 January 2025 those must be able to receive e-invoices, and the issuing obligation phases in over 2027 and 2028 (bundesfinanzministerium.de FAQ, updated March 2026, checked 2026-09-28). A German contractor may still send you a ZUGFeRD file, which is a PDF with embedded XML.

Does the Kleinunternehmer VAT exemption matter to a foreign client?

Rarely. A contractor is a Kleinunternehmer if turnover was at most €25,000 last year and stays at most €100,000 this year (§19 UStG). Services to a foreign business are supplied abroad and do not count toward that turnover, and the invoice carries no German VAT either way (existenzgruendungsportal.de, checked 2026-09-28).
