How to pay contractors in Portugal

A foreign company pays a Portuguese contractor in euros by SEPA transfer to the contractor’s IBAN, against the fatura or fatura-recibo the contractor issues on the tax authority’s Portal das Finanças, either from its own bank or through a payout platform. The transfer is cheap and fast, so the choice of tool depends on how many contractors you pay, what your finance team needs on file, and how much of each contractor’s income comes from you.

Most Portuguese freelancers work as a trabalhador independente, the self-employed status everyone calls “recibos verdes”. Two Portuguese rules reach the client rather than the contractor. A business that takes more than half of a contractor’s service income in a year owes Social Security 7% of those invoices, or 10% above 80% (seg-social.pt, checked 2026-09-28). And Article 12 of the Labour Code presumes employment when the work looks like a job, with the labour inspectorate able to open a case without the worker going to court.

Nothing is withheld on your side, there is no currency control, and a B2B invoice to a company abroad carries no Portuguese VAT. One contractor on project work is well served by a low-cost SEPA rail. A team, or a full-time engagement where you are the only client, points to a platform that holds contracts and documents, or to a Contractor of Record.

How to choose: four questions for paying Portuguese contractors

Money reaches Portugal easily by SEPA. What separates the options is the rules on the client’s side, and four questions settle it.

1. How much of the contractor’s income comes from you

Portugal bills part of a contractor’s social protection to the client. If you receive more than 50% of the contractor’s service income in a calendar year, you are an entidade contratante and owe 7% of the year’s invoices; above 80%, 10%. Segurança Social assesses it the following year from the contractor’s annual declaration, payable by the 20th of the month after the notice (seg-social.pt, guide of 12 January 2026, checked 2026-09-28).

It applies only if the contractor is paying contributions and earned at least six times the IAS, €3,222.78 in 2026. A new contractor’s contributions start only on the first day of the twelfth month after opening activity, so no client qualifies before then (OCC, August 2026, checked 2026-09-28).

For a company abroad the answer is not settled. The rule sets no residence test, and the contractor’s declaration identifies foreign clients by country code and foreign tax number (Anexo SS instructions, checked 2026-09-28). The official guide does not explain how a client with no Portuguese registration is notified or pays.

If you are one client among several: this does not apply. If you take most of the contractor’s income: budget 7–10% on top of the invoices until a Portuguese adviser tells you otherwise, then read question 2.

2. How employment-like the engagement is

Article 12 of the Labour Code presumes an employment contract when some of these are present: work at a place you own or choose, your equipment, start and finish times you set, a fixed amount paid at regular intervals, or a management role in your structure. Work done as self-employed under those conditions is a very serious offence (informador.pt, checked 2026-09-28). The labour inspectorate (ACT) does not wait for the worker to sue: it notifies the business to regularise within 10 days, then passes the case to the public prosecutor (Law 63/2013, checked 2026-09-28).

A monthly flat fee, your laptop and daily stand-ups at fixed hours tick three boxes. A fixed-price project, the contractor’s own tools and schedule, and other clients tick none.

If the engagement is genuinely independent: a transfer rail or a contractor management platform. If it is independent but you want someone else to hold the contract and reduce your misclassification risk: a Contractor of Record, after reading its indemnification clause. 4dev is a Contractor of Record that serves as the contracting party for each contractor, which reduces reclassification risk. 3. Whether you pay from euros or dollars

From an EU euro account, a SEPA transfer is the cheapest route, and euro-area banks may not charge more for an instant transfer than for a standard one (ECB, checked 2026-09-28). From dollars, Wise showed USD 9.87 to send USD 1,000 to Portugal funded by bank transfer (wise.com, checked 2026-09-28). A dollar wire straight to the contractor’s bank triggers the bank’s charge for transfers from outside the SEPA framework, with 4% stamp duty on it and any correspondent fees (BPI price list, in force from 17 August 2026, checked 2026-09-28).

If you hold euros: SEPA from your bank, or any platform with SEPA payout. If you hold dollars: a provider that converts at a disclosed rate and pays out locally in EUR.

4. How many contractors, and what finance needs on file

On fees alone, a $29 monthly seat costs less than a 3% fee once a contractor bills over $967 a month, and a $40 seat once they bill over $1,333.

A Portuguese contractor may send a fatura now and a recibo after your payment arrives, or a single fatura-recibo (AT user guide, checked 2026-09-28). Without Portal das Finanças access you receive them as PDFs, to match against contracts and payments.

Portugal has no currency control on these payments: the EU treaty prohibits restrictions on payments between member states and with non-EU countries (TFEU Art. 63, checked 2026-09-28). Banks still screen for sanctions and money laundering.

What the Portuguese contractor needs to get paid

The usual status is trabalhador independente, paid on “recibos verdes”. To take your money legally the contractor:

  • Opens activity with the tax authority (AT) by filing a declaração de início de atividade, at the latest on the day the work starts (gov.pt, checked 2026-09-28).
  • Issues each invoice on the Portal das Finanças: a fatura followed by a recibo once paid, or a single fatura-recibo. A foreign client goes on it by name and foreign tax number (AT user guide, checked 2026-09-28).
  • Pays IRS on the simplified regime if fees stayed under €200,000 the year before (Art. 28 CIRS). 75% of fees from the professions on the official list is taxable (35% for other services), and for listed professions at least 15% of fees must be backed by expenses (Art. 31). Rates run from 12.5% to 48% in 2026 (Art. 68; all checked 2026-09-28).
  • Pays Social Security at 21.4% on 70% of service income, declared quarterly in January, April, July and October (OCC, checked 2026-09-28).
  • Handles VAT status. With turnover in Portugal of no more than €15,000 in the previous year, the contractor can stay VAT-exempt under Article 53 (portaldasfinancas.gov.pt, checked 2026-09-28).

Documents and tax on your side

Withholding. Portuguese IRS withholding on self-employed fees (23% for listed professions) falls on payers that have or must keep organised accounts (Art. 101 CIRS, checked 2026-09-28). The AT guide tells contractors to fill the withholding box only for such clients, so an invoice to you should show none: pay the gross.

VAT. Portugal taxes a service to a business only when that business is established in Portugal (Art. 6(6)(a) CIVA). Invoices to EU businesses carry “IVA - autoliquidação” because you self-account (Art. 36(13); both checked 2026-09-28). EU payers should check the contractor’s PT VAT number in VIES.

The client contribution. If you take more than half of a contractor’s service income, the 7% or 10% entidade contratante contribution (see “How to choose”) may apply. It is billed to the client after the year ends, never deducted from the invoice.

US payers. Pay for personal services is sourced where the work is done, and foreign-source income paid to a non-resident is not subject to NRA withholding (irs.gov; irs.gov, checked 2026-09-28). Collect a Form W-8BEN from an individual (W-8BEN-E from a Portuguese company such as an Lda.) and file no 1099. The US–Portugal treaty matters only if the contractor works from the US: it allows US tax on independent services through a US fixed base or a stay of 183 days in 12 months (Art. 15, irs.gov, checked 2026-09-28)

What to keep, per contractor:

  1. The signed services contract, with scope, rate, currency and IP assignment.
  2. Every fatura or fatura-recibo, plus the recibo where one follows a fatura.
  3. Proof of payment matching each document.
  4. W-8BEN (US payers) or the VIES check (EU payers).

Where payments to Portugal break

  • A fatura with no recibo. When the contractor invoices first, the recibo comes only after your money arrives. Chase it, or your file shows an invoice with no receipt.
  • Portuguese VAT on an invoice to a foreign business. A 23% line on a B2B invoice to a company abroad is a contractor error; ask for a corrected document before paying rather than paying the VAT.
  • USD sent to a EUR account. The Portuguese bank converts at its own rate and adds its commission for transfers from outside SEPA, so the contractor is short against the invoice. Pay in EUR or through a rail with local payout.
  • Name mismatch. Since 9 October 2025 euro-area banks must offer a free check of the payee name against the IBAN before a transfer (ECB, checked 2026-09-28). The name on the contract and invoice should match the account holder.
  • A contribution notice a year later. The entidade contratante charge is calculated after the year closes, so it surfaces long after the last payment.
  • A first-payout KYC hold. Platforms verify both sides before money moves. Collect the contractor’s ID, NIF and proof of opened activity at onboarding.
  • An ACT notice. A full-time, single-client engagement on your equipment and hours can be treated as a disguised employment contract, with 10 days to regularise. The payment goes through; the risk sits in the relationship. See contractor misclassification and the Contractor of Record rating.

What's the cheapest way to pay a contractor in Portugal?

Can I pay a contractor in Portugal in USD?

Yes. There is no currency control on service payments into Portugal, and Portuguese banks accept SWIFT transfers in USD. They price incoming transfers from outside the EU cross-border payments regulation separately: BPI's 2026 price list adds a commission with 4% stamp duty and passes on correspondent-bank charges (bancobpi.pt, checked 2026-09-28). Agree the invoice currency and who bears conversion in the contract.

Do I need to withhold tax when paying a contractor in Portugal?

Not as a foreign client. Portuguese IRS withholding on self-employed fees, 23% for the professions on the official list, is an obligation of payers that have or must keep organised accounts (Art. 101 CIRS, portaldasfinancas.gov.pt, checked 2026-09-28), and the tax authority's invoicing guide tells contractors to fill in withholding only when the client keeps accounts. US payers collect Form W-8BEN; pay for work performed in Portugal is foreign-source income (irs.gov, checked 2026-09-28).

Do I pay Portuguese VAT on a Portuguese contractor's invoice?

Not as a business client abroad. Portugal taxes services to a business only when that business is established in Portugal (Art. 6(6)(a) CIVA), so the invoice carries no Portuguese VAT. Invoices to EU businesses must carry the words 'IVA - autoliquidação', because you account for VAT yourself (Art. 36(13) CIVA) (portaldasfinancas.gov.pt, checked 2026-09-28). The standard mainland rate you would otherwise see is 23% (PwC, reviewed 2026-07-24).

What is a recibo verde, and which documents will I receive?

It is the everyday name for the invoice a self-employed worker issues on the tax authority's Portal das Finanças. You get a fatura-recibo when payment happens at the time of the service, or a fatura first and a separate recibo once your payment arrives; a foreign client is identified by name and foreign tax number (AT user guide, checked 2026-09-28). Before invoicing, the contractor must file a declaração de início de atividade, at the latest on the day work starts (gov.pt, checked 2026-09-28).

Will I owe Portuguese Social Security if my contractor works only for me?

Possibly. A business that receives more than 50% of a self-employed worker's service income in a year is an 'entidade contratante' and pays 7% of that year's invoices, or 10% above 80%, if the worker is paying contributions and earned at least €3,222.78 (six times the 2026 IAS) (seg-social.pt, guide of 12 January 2026, checked 2026-09-28). The rule sets no residence test, and the contractor's annual Anexo SS names clients abroad by country code and foreign tax number. The guide does not say how a client with no Portuguese registration is notified or pays, so take Portuguese advice.

Can a Portuguese contractor be reclassified as an employee in 2026?

Yes. Article 12 of the Labour Code presumes an employment contract when some of five indicators are present, such as the client's premises or equipment, hours the client sets, or a fixed amount paid at regular intervals, and disguised self-employment is a very serious offence (informador.pt, checked 2026-09-28). The labour inspectorate (ACT) gives the business 10 days to regularise before the case goes to the public prosecutor (dre.pt, checked 2026-09-28). Parliament rejected the Trabalho XXI labour reform on 19 June 2026, so these rules stand (cnnportugal.iol.pt, checked 2026-09-28).

Can I pay a Portuguese contractor through MB WAY?

Not from a foreign account. MB WAY works with a card issued by a participating Portuguese bank (mbway.pt, checked 2026-09-28), and at BPI its transfers are capped at €750 per operation and €2,500 a month (bancobpi.pt, checked 2026-09-28). A company abroad pays the contractor's IBAN by SEPA instead.
