Costa Rica works well for contractor engagements when the person really is independent: a trabajador independiente registers with Hacienda, invoices electronically, pays their own income tax and CCSS contributions, and charges no IVA on services used abroad. The exposure is classification. Labour Code art. 18 presumes an employment contract between whoever works and whoever receives the service, and calls a contract of employment any in which a person serves another under dependence and direction for pay, whatever it is named (Código de Trabajo, checked 2026-10-07).

Where the contractor model can break

The MTSS legal department, citing an ILO report, lists signs of subordination: the worker serves one company, the client supplies the tools, gives instructions and chooses the place, the worker takes no commercial risk, the tasks match those of the client’s employees, the client sets hours, and the work is regular and continuous (DAJ-AE-237-13, checked 2026-10-07). Full-time, open-ended, single-client work that sits inside your team ticks most of them.

If a court finds employment, the contractor gains paid vacation of two weeks per 50 weeks worked (art. 153) and severance on dismissal without cause (art. 29), and employer-side CCSS charges of 26.83% become due (PwC, updated 2026-06-30). Claims prescribe one year after the contract ends (art. 413). Multiple clients, project scope, the contractor’s own tools and schedule, and a fee for results rather than hours are what keep the relationship on the right side.

What to put in the contract

  • A written services agreement with the individual, scoped to deliverables, fee and currency.
  • Where the service is used. Name your company and country and state that the service is used outside Costa Rica; the IVA exemption depends on it.
  • IP assignment in writing. Art. 40 of the copyright law gives economic rights to the commissioning party only for works composed to a plan supplied by an editor, and to the employer for a salaried author, with moral rights staying with the author (Ley 6683, art. 40, checked 2026-10-07). A developer working to their own plan is not clearly covered; assign the economic rights expressly.
  • Independence markers: own tools, own schedule, right to serve other clients.

Taxes and paperwork

The contractor’s side. Register with Hacienda within ten business days of starting, with an economic-activity code and electronic invoicing configured (alegra.com, checked 2026-10-07). Income tax is progressive: 0% up to CRC 4,094,000 of annual net income, then 10%, 15%, 20% and 25% above CRC 20,442,000, and services rendered in Costa Rica are Costa Rican-source income even for a foreign client (PwC, updated 2026-06-30). The contractor enrols with the CCSS and pays 7.05% to 19.11% of reported income, by band (crhoy.com, 2026-05-07). IVA is 13%, or exempt with right to credit if the service is used abroad, shown on a factura electrónica (observador.cr, checked 2026-10-07).

The client’s side. Pay against invoices. The withholding rates in PwC’s summary attach to payments by Costa Rican taxpayers; we found no rule that makes a foreign company with no local entity withhold from a resident contractor, so on our reading it pays gross. With a Costa Rican subsidiary, ask a local accountant. There is no US–Costa Rica income tax treaty (irs.gov, checked 2026-10-07); US payers collect a W-8BEN and, because the place of performance decides the source of the income (irs.gov, checked 2026-10-07), file no 1099. Keep the contract and invoices.

Can a foreign company hire an independent contractor in Costa Rica without a local entity?

Yes. A foreign company can sign a services contract with a Costa Rican individual and pay them from abroad; the contractor registers with Hacienda, invoices and pays their own taxes and CCSS contributions. The risk is in the relationship: art. 18 of the Labour Code calls any contract of service under dependence and direction, for pay, an employment contract whatever its name (mtss.go.cr, checked 2026-10-07).

What does a Costa Rican contractor need to register?

A cédula, a Hacienda registration with an economic-activity code and electronic invoicing, and CCSS enrolment as an independent worker. Hacienda registration is due within ten business days of starting activity, with penalties of CRC 225,100 to 1,350,600 for late filing (alegra.com, checked 2026-10-07).

Does a Costa Rican contractor charge IVA?

The general rate is 13% (PwC, updated 2026-06-30). Services provided by IVA taxpayers and used outside Costa Rica are exempt with right to credit, and the contractor issues a factura electrónica showing it; a service used in Costa Rica gets a tiquete electrónico and 13% (observador.cr, checked 2026-10-07).

What happens if a contractor is reclassified as an employee in Costa Rica?

Can I convert a Costa Rican contractor to an employee?
